I filed bankruptcy on my own in December 2000, it was discharged in April 2001. My husband has been recently diagnosed with bi-polar disorder and is receiving little income. As a result, all of our bills are getting behind and we are going to have to file again or we are going to lose what little we have left. I read somewhere that you can file again after 8 years. Is this true? He has filed for disability, but I have a feeling it will get denied the first time around. Also, when I filed it was a matter of getting all my bills together and giving it to the lawyer. I know the laws have changed since then, can someone tell me what I would have to do now to file, if I'm eligible again?

If you file Chapter 7 and receive a discharge, you cannot file another Chapter 7 until 8 years after the first was filed, and you cannot file Chapter 13 until 4 years have passed after the first was filed.



So if you filed in 2000, you're free to file again.

he will get denied the first time. maybe even the second. make sure you are stable enough to keep paying on your home or apt. before you file. once you file and its completed NO one will rent to you...except for private renters.



you can probably file again now, i was under the impressions it was a 7 year wait to file again. call a bankruptcy attorney, he will tell you when, but its probably very soon.

What you want to do first, is to freeze both yours and his credit to make sure that he can't open any more accounts up and also remove his name from the bank accounts and take the debit/credit cards away form him and take his name off of the account...he might not like it, but it's the way to save you during his manic phases.



Also, contact a legitimate credit repair service and have them consolodate your bills and put on a strict plan, which he may not like being bi polar. Credit Counseling Services is the one that is well known.



Your not indicating how long it's been since he's filed for disability, but he can get approved quicker, especially if he's had any recent hospitalizations. There are many indivialas who have bi polar who are productive members of society. I had a father that was and my neice and my daguhter is also. My daughter is on medication and is a Pastry Chef. She deals with dpression and anxiety but knows how to control it. Disaiblity may not be the best option for you, if there was other things invovled and if he's been hospitalized it might help with that.



Another maneuver that you can do is file for a legal seperation. That way, you can save your credit for paper purposes and the damage that he does on his own is HIS issue, not yours. I'm not sayign tha tyou have to go through with the divorce, but that is one way to protect yourself legally because what he will be doing will no long be "joint", it will be consdiered seperate.
